00:00:00.381 --> 00:00:02.087
Hi Warriors, welcome to 1 in 3,.
00:00:02.087 --> 00:00:03.250
I'm your host, ingrid.
00:00:03.250 --> 00:00:09.192
Sometimes claims of domestic violence aren't clear, even unbelievable.
00:00:09.192 --> 00:00:13.550
So how does one differentiate between the truth and the lies?
00:00:13.550 --> 00:00:16.347
I don't have that answer.
00:00:16.347 --> 00:00:21.803
A prime example of this is the story of Jane and Dave Lout.
00:00:21.803 --> 00:00:45.438
Dave and Jane Lout met when they both attended Santa Clara High School in Oxford, california.
00:00:45.438 --> 00:00:53.362
Jane played volleyball and was homecoming queen.
00:00:53.362 --> 00:00:55.587
Dave was an athletic star who participated in football, basketball and track.
00:00:55.587 --> 00:01:00.241
Following graduation, dave attended UCLA where he broke records for shot put.
00:01:00.241 --> 00:01:03.167
He even scored a bronze medal in the Olympics.
00:01:03.167 --> 00:01:07.121
The couple didn't begin dating until after high school.
00:01:07.121 --> 00:01:10.087
They married in December of 1980.
00:01:10.087 --> 00:01:12.371
A picture-perfect couple.
00:01:12.371 --> 00:01:15.245
The two soon realized they were unable to conceive.
00:01:15.245 --> 00:01:21.725
That wasn't an issue for them, as they happily adopted their son, michael, from South Korea in 1999.
00:01:22.466 --> 00:01:26.635
According to Jane, dave's abuse began shortly after Michael was five years old.
00:01:26.635 --> 00:01:29.986
She had noticed his temper before when they were dating.
00:01:29.986 --> 00:01:35.325
She recalled the first time he hit her was when he was preparing for Olympic training.
00:01:35.325 --> 00:01:38.492
Out of town, jane was in charge of packing.
00:01:38.492 --> 00:01:42.308
She had forgotten to purchase some items toilet maybe.
00:01:42.308 --> 00:01:46.177
Dave was stressed and angry and hit her in the face.
00:01:46.177 --> 00:01:49.384
She suffered a split lip and a black eye.
00:01:49.384 --> 00:01:55.194
He brushed it off, telling her to say some N-word, did it?
00:01:55.194 --> 00:01:57.143
Jane complied.
00:01:57.143 --> 00:02:02.718
She constructed a story of how a black man mugged her, jane mentioned.
00:02:02.718 --> 00:02:05.268
The majority of the abuse was mostly verbal, however.
00:02:05.268 --> 00:02:16.370
She suffered from mental and emotional repercussions from being called fat bitch, stupid, idiot and a variety of racially inappropriate names.
00:02:16.370 --> 00:02:20.383
As Michael aged, he was also included in the abuse.
00:02:21.686 --> 00:02:26.794
Dave began to acquire guns and would often taunt his wife and son with a collection.
00:02:26.794 --> 00:02:29.885
He wanted Jane to play Russian roulette.
00:02:29.885 --> 00:02:41.825
If you're unfamiliar with Russian roulette, it involves placing one bullet into a revolver, the cylinder of the revolver is spun and the muzzle of the gun is typically placed on the temple of a person.
00:02:41.825 --> 00:02:48.062
The trigger is then pulled, with a one in six chance of a resultant fatal gunshot.
00:02:48.062 --> 00:02:52.852
Jane detailed how Dave's abuse escalated as the years went on.
00:02:52.852 --> 00:02:58.913
For the last two years leading to his death, dave was notably abusive nearly every day.
00:02:58.913 --> 00:03:03.263
Previously he was known to get angry, but then it would taper off.
00:03:03.263 --> 00:03:07.530
During those last few years, jane lamented as Dave drank.
00:03:07.530 --> 00:03:11.015
He would rage at absolutely everything.
00:03:11.015 --> 00:03:19.614
It became a terrifying enough experience for Michael that he asked Jane to sleep in his room each night for those two years.
00:03:20.920 --> 00:03:24.366
Jane and Michael spent August 27, 2009 at the beach.
00:03:24.366 --> 00:03:26.207
Jane and Michael spent August 27, 2009 at the beach.
00:03:26.207 --> 00:03:30.754
Dave's foul mood was quickly made apparent as he again began to rage.
00:03:30.754 --> 00:03:39.000
No-transcript.
00:03:39.000 --> 00:03:40.282
That night Dave had also been drinking.
00:03:41.254 --> 00:03:50.901
Jane positioned herself outside of Michael's room in attempts to assess the situation and intervene if necessary, expecting Dave to eventually calm down.
00:03:50.901 --> 00:03:53.867
She was surprised when he began heading to Michael's room.
00:03:53.867 --> 00:04:02.669
While holding his .22 caliber single action revolver, jane overheard Dave muttering something about killing Michael.
00:04:02.669 --> 00:04:08.106
Her goal then shifted to getting Dave to a place far away from their son.
00:04:08.106 --> 00:04:11.465
The couple headed out the door to the backyard.
00:04:11.465 --> 00:04:13.018
At some point.
00:04:13.018 --> 00:04:15.344
Jane believed they struggled for the gun.
00:04:15.344 --> 00:04:20.726
She denied recollection of shooting the weapon but admitted to feeling it discharge.
00:04:20.726 --> 00:04:25.798
She remembered sitting over Dave at one point but did not know how.
00:04:25.798 --> 00:04:28.165
Five more shots were fired.
00:04:28.165 --> 00:04:31.634
Jane made her way back inside to call 911.
00:04:31.634 --> 00:04:37.247
She explained how there was a possible prowler outside which her husband had gone to investigate.
00:04:37.247 --> 00:04:40.802
She then told the operator she heard shots fired.
00:04:40.802 --> 00:04:48.382
When Jane was taken in for questioning, she stuck to the original story but eventually changed it to something paralleling
00:04:48.783 --> 00:04:49.425
self-defense.
00:04:49.425 --> 00:05:00.923
At some point police questioned Jane's sister-in-law, rebecca Laut, who verified Jane, confided in her the details of verbal, psychological and emotional abuse.
00:05:00.923 --> 00:05:07.721
Well, if that was all to the story, it would be a fairly open and shut case in a super short episode.
00:05:07.721 --> 00:05:09.504
But that wasn't everything.
00:05:09.504 --> 00:05:16.704
Early in the investigation, things didn't seem to line up with Jane's story Either of Jane's stories.
00:05:16.704 --> 00:05:20.778
The gun was found hidden at the bottom of a grandfather clock.
00:05:20.778 --> 00:05:25.228
Jane had also clearly washed up and changed her clothes.
00:05:25.228 --> 00:05:30.406
Both things were thought to be something a person acting in self-defense would not do.
00:05:30.406 --> 00:05:35.990
Jane was arrested for the murder of Dave six months after he was killed.
00:05:35.990 --> 00:05:43.415
She was released on bond and remained free for the next six years while awaiting trial, and remained free for the next six years while awaiting trial.
00:05:43.415 --> 00:05:46.418
Finally, jane's court date arrived on January 11,
00:05:46.759 --> 00:05:47.939
2016.
00:05:47.939 --> 00:05:54.586
Dave's friends and families were interviewed and denied any knowledge of abuse Any kind of abuse.
00:05:54.586 --> 00:06:00.610
In fact, jane's apparent meek and quiet character quickly became tarnished.
00:06:00.610 --> 00:06:02.072
Remember Rebecca?
00:06:02.072 --> 00:06:06.298
She initially told police about Dave's verbal abuse.
00:06:06.298 --> 00:06:10.887
Well, she recanted, stating she no longer believed Dave had abused Jane.
00:06:10.887 --> 00:06:14.863
Instead, she felt Jane was somewhat of a pathological liar.
00:06:14.863 --> 00:06:28.560
She gave examples of how Jane had fabricated stories of being attacked by a stalker, twice being held at knife point during a robbery and other tales Rebecca described as outlandish.
00:06:28.560 --> 00:06:34.009
Dave's mother revealed Jane had borrowed upwards of $60,000.
00:06:34.009 --> 00:06:42.303
The couple had apparently failed to pay for taxes for the last few years and were behind in a few months of mortgage payments.
00:06:42.303 --> 00:06:48.725
There was also question regarding the PTA funds for Michael's school, which Jane was the treasurer.
00:06:48.725 --> 00:06:54.745
Conveniently, dave had a $300,000 life insurance policy.
00:06:54.745 --> 00:06:59.980
Interestingly, dave had been researching divorce attorneys the night he was
00:07:00.060 --> 00:07:00.382
killed.
00:07:00.382 --> 00:07:10.103
The prosecution presented a solid case of Jane fabricating a story of domestic abuse in order to cover up first-degree murder.
00:07:10.103 --> 00:07:18.850
After all, dave suffered two shots to the back of his head, one in his back, two to his face and one in his arm.
00:07:18.850 --> 00:07:22.262
Some of the shots were found to be at close proximity.
00:07:22.262 --> 00:07:33.759
Jane clearly decided to murder her husband to collect the life insurance payout and out of fear of losing her son in a custody battle if Dave did file for divorce.
00:07:33.759 --> 00:07:37.786
Huh, so now this case seems pretty evident.
00:07:37.786 --> 00:07:38.588
Jane murdered
00:07:38.629 --> 00:07:38.928
Dave.
00:07:38.928 --> 00:07:43.742
Well, jane's legal team maintained self-defense.
00:07:43.742 --> 00:07:51.588
She had been offered at least five plea deals, including one in which she would serve a maximum sentence of six years.
00:07:51.588 --> 00:07:57.588
She turned them all down because she wanted people to learn the truth of what happened.
00:07:57.588 --> 00:08:06.490
She had suffered years of verbal, emotional, psychological as well as physical and sexual abuse at the hand of her husband.
00:08:06.490 --> 00:08:11.007
Jane had friends, family and colleagues who also testified.
00:08:11.007 --> 00:08:20.189
They mentioned black eyes, strange bruises and the fact that Jane would often wear long-sleeved clothing even in hot
00:08:20.228 --> 00:08:20.509
weather.
00:08:20.509 --> 00:08:24.466
One of the witnesses was a now 17-year-old, michael.
00:08:24.466 --> 00:08:29.867
He backed his mother's claims of verbal, emotional and psychological abuse.
00:08:29.867 --> 00:08:35.405
He spoke of his father's temper but did not recall any physical abuse.
00:08:35.405 --> 00:08:41.855
Jane answered the question of why she didn't leave earlier in the relationship with a belief that things would get better.
00:08:41.855 --> 00:08:47.167
She opposed the financial accusations, saying Dave was the primary offender.
00:08:47.167 --> 00:08:55.466
Jane couldn't place where the borrowed money went beyond the $20,000 she claimed Dave threw into a fire during a fit of rage.
00:08:55.466 --> 00:09:01.144
She also maintained her inability to recall the events of the night Dave was killed.
00:09:01.144 --> 00:09:03.568
That sounds kind of fishy, doesn't
00:09:03.629 --> 00:09:03.668
it?
00:09:03.668 --> 00:09:07.745
Psychologist Catherine Emmerich also testified.
00:09:07.745 --> 00:09:14.922
She presented the verbal, psychological, emotional, physical and sexual abuse examples that were told to her by Jane.
00:09:14.922 --> 00:09:18.792
She diagnosed Jane with battered wife syndrome.
00:09:18.792 --> 00:09:22.544
So what exactly is battered wife syndrome?
00:09:22.544 --> 00:09:29.969
Battered wife syndrome, also referred to today as battered person syndrome, is a type of PTSD.
00:09:29.969 --> 00:09:35.726
It is determined to be a psychological effect of intimate partner violence.
00:09:35.726 --> 00:09:52.067
Symptoms include anxiety with triggers, flashbacks, nightmares, avoidance, depression, amnesia and disassociation, headaches, joint pain, chronic pain and autoimmune-related issues are some physical effects.
00:09:52.067 --> 00:09:55.660
Okay then, that was the gist of the
00:09:55.701 --> 00:09:56.081
trial.
00:09:56.081 --> 00:10:05.187
The jury had options of first-degree murder, manslaughter or justifiable homicide, which would result in an acquittal.
00:10:05.187 --> 00:10:10.206
They took four days to deliberate on the 59-year-old woman's fate.
00:10:10.206 --> 00:10:17.447
Returning to the courtroom, the jury found Jane Lout guilty of first-degree murder.
00:10:17.447 --> 00:10:20.703
Her sentence 50 years to life.
00:10:20.703 --> 00:10:27.008
She received 25 years for murder and 25 years for use of a gun in the murder.
00:10:27.008 --> 00:10:31.402
In 2019, the appellate court upheld her
00:10:31.442 --> 00:10:32.023
conviction.
00:10:32.023 --> 00:10:35.809
So did Jane drag the family into debt?
00:10:35.809 --> 00:10:46.576
Did Dave try to do the responsible thing and look into divorce, fearful of divorce and losing her son while counting the dollar signs of a large life insurance payout?
00:10:46.576 --> 00:10:48.760
Did Jane resort to murder?
00:10:48.760 --> 00:10:54.115
The jury believed so, but did the jury get it wrong?
00:10:54.115 --> 00:11:00.086
Was Jane, like so many domestic violence victims, ashamed of the abuse?
00:11:00.086 --> 00:11:03.562
Did she hide it to keep the perfect life facade?
00:11:03.562 --> 00:11:15.658
Was she afraid of the repercussions if she did tell, if she had not killed her abusive husband, would she and her son indeed be dead themselves, like she
00:11:15.697 --> 00:11:16.198
believed?
00:11:16.198 --> 00:11:26.958
I mentioned at the beginning of this episode how it can sometimes be difficult to differentiate if someone is telling the truth about abuse or if they are fabricating their story.
00:11:26.958 --> 00:11:46.167
Another fact I found among different sources is that the rate of false abuse claims is quite low, ranging from just 2 to 15% of all reported cases, and, to be honest, that 15% was high amongst most of the sources I found.
00:11:46.167 --> 00:11:50.365
I'll leave it up to you to come to your own conclusion on this one.
00:11:50.365 --> 00:11:54.846
What I would like to impart is the importance of speaking up.
00:11:54.846 --> 00:12:05.429
Jane had witnesses testify to what they believed was abuse, but they testified at her trial for murdering her
00:12:05.490 --> 00:12:05.951
husband.
00:12:05.951 --> 00:12:10.941
When it comes to domestic violence, I have found that people prefer to stay out of it.
00:12:10.941 --> 00:12:14.008
I mean, really can you blame them?
00:12:14.008 --> 00:12:16.599
It's a pretty big accusation.
00:12:16.599 --> 00:12:18.263
What if they're wrong?
00:12:18.263 --> 00:12:20.187
What if the victim doesn't want help?
00:12:20.187 --> 00:12:22.758
What if the abuser finds out and comes for them?
00:12:22.758 --> 00:12:29.048
What if saying something would ruin their personal or professional relationship with either the victim or the abuser?
00:12:29.048 --> 00:12:42.200
There are plenty of reasons to hesitate or ignore, but the one reason to say something, do something, is that you could help save a
00:12:42.280 --> 00:12:42.520
life.
00:12:42.520 --> 00:12:44.767
Thank you for listening.
